Terms & Conditions

These Terms & Conditions apply to purchases made from Phipower through phipower.org and any other sales channel operated by Phipower. By placing an order, the Customer confirms that they have had the opportunity to read and save these Terms & Conditions.

1. Definitions

Phipower means Phipower, operated under Mobisun B.V., established in Nijkerk, the Netherlands, registered with the Dutch Chamber of Commerce under number 68972849.

Customer means any natural person or legal entity entering into an agreement with Phipower.

Consumer means a natural person acting for purposes outside their trade, business, craft or profession.

Business Customer means a Customer acting for purposes relating to their trade, business or profession.

Product means any physical product, accessory or other item offered by Phipower.

Agreement means the sales agreement between Phipower and the Customer.

Distance Contract means an Agreement concluded online or through another means of distance communication without Phipower and the Consumer being physically present at the same time.

Day means a calendar day.

3. Applicability

These Terms & Conditions apply to all offers, orders and Agreements between Phipower and the Customer unless explicitly agreed otherwise in writing.

Before an online Agreement is concluded, the Customer will be given a reasonable opportunity to review these Terms & Conditions electronically.

The version of the Terms & Conditions applicable at the moment the Agreement is concluded remains applicable to that Agreement.

If separate product-specific conditions, manuals, safety instructions or written quotations apply, these form part of the Agreement where relevant.

If a provision in these Terms conflicts with mandatory consumer law, the mandatory legal provision takes precedence.

For Business Customers, additional or different terms may be agreed in a quotation, purchase agreement or other written agreement.

4. Products and offers

Phipower aims to describe its Products accurately and clearly.

Product information may include specifications, dimensions, materials, photographs, videos, operating principles, instructions and intended uses.

Images are intended to represent Products as accurately as reasonably possible. Minor differences in colour, finish or appearance may occur as a result of lighting, screens, production batches or handcrafted components.

Minor variations that do not materially affect the agreed functionality of a Product do not automatically constitute a defect.

Offers are subject to availability unless explicitly stated otherwise.

Obvious typographical, technical or pricing errors do not bind Phipower where the Customer could reasonably understand that an error has occurred.

Phipower may correct such errors before fulfilling the order. If an order cannot reasonably be fulfilled because of an obvious error, Phipower may cancel the order and refund any amount already paid.

5. Wellness information and product claims

Phipower offers products relating to areas including water preparation, frequency technology, molecular hydrogen, light and meditation.

Unless explicitly stated otherwise for a particular certified Product, Phipower Products are offered as wellness, lifestyle, meditation or research-oriented products and not as medical devices.

They are not intended to diagnose, treat, cure or prevent disease.

Information published by Phipower through product pages, manuals, the Knowledge Center, articles, newsletters or customer support is intended for general product, technical or educational purposes.

Such information is not a substitute for professional medical diagnosis, treatment or advice.

Phipower distinguishes, where reasonably possible, between:

  • measurable physical or technical characteristics;
  • published scientific evidence;
  • hypotheses or theoretical interpretations;
  • historical or traditional concepts; and
  • subjective personal experiences.

A measurable characteristic such as a frequency, wavelength, vortex speed, hydrogen concentration or geometric dimension does not by itself establish a therapeutic or medical effect.

Traditional or alternative-wellness concepts such as sacred geometry, crystals, structured or vitalized water, frequency traditions or subjective energy experiences should not automatically be interpreted as scientifically established medical effects.

Individual experiences may vary.

Nothing in this Article limits Phipower's obligations concerning product safety, conformity or truthful product descriptions.

6. Conclusion of the Agreement

The Customer places an order by completing the checkout process and submitting the order.

Phipower will send an electronic confirmation of receipt of the order.

The Agreement is concluded when Phipower accepts the order, subject to successful payment authorization and product availability.

Phipower may refuse or cancel an order where there is a legitimate reason, including:

  • suspected fraud or abuse;
  • an obvious pricing or technical error;
  • payment failure;
  • legal restrictions;
  • inability to deliver to the chosen destination; or
  • unexpected unavailability of the Product.

If Phipower cancels an order after payment has been received, Phipower will refund the amount paid.

For Business Customers ordering through a quotation, the Agreement is concluded according to the acceptance provisions stated in the quotation or other written agreement.

7. Prices, VAT and additional costs

Consumer prices displayed by Phipower include applicable VAT unless clearly stated otherwise.

Shipping costs and other compulsory charges are displayed before the order is submitted.

The Customer is not required to pay additional charges that were not properly disclosed before the Agreement was concluded.

For deliveries outside the European Union, import duties, local taxes, customs charges or carrier handling fees may apply.

Unless Phipower expressly states that such charges are included, they are the responsibility of the recipient.

The final amount payable is displayed before the Customer confirms the order.

8. Payment

The Customer must pay using one of the payment methods offered during checkout.

Phipower may wait to fulfil an order until payment has been successfully authorized or received.

The Customer is responsible for providing complete and accurate payment and billing information.

If payment is overdue, Phipower may issue a payment reminder and may charge statutory interest or collection costs where permitted by law.

For Consumers, statutory rules concerning payment reminders and collection costs apply.

Products remain the property of Phipower until the purchase price has been paid in full.

9. Delivery

Phipower delivers to the countries and destinations made available during checkout.

The Customer is responsible for providing a correct and complete delivery address.

Delivery times shown on the website are estimates unless a specific delivery deadline has expressly been agreed.

Where no other period is agreed, consumer orders must be delivered within the legally applicable period. Under current EU/NL online-sales rules, the seller generally bears the risk of loss or damage until the Consumer receives the Product, and if no other delivery period has been agreed, delivery should normally take place within 30 days.

If delivery is delayed, the Consumer may give Phipower a reasonable additional period to deliver where required by law.

If Phipower still fails to deliver within that additional period, the Consumer may have the right to terminate the Agreement and receive a refund.

An additional period is not required where Phipower refuses to deliver or where an agreed delivery date was essential to the Agreement.

Phipower is not responsible for delays caused by incorrect delivery information supplied by the Customer.

10. Statutory 14-day right of withdrawal

A Consumer purchasing through a Distance Contract generally has the legal right to withdraw from the Agreement within 14 days without giving a reason.

For goods, this period starts on the day after the Consumer, or a third party designated by the Consumer other than the carrier, receives the Product.

Where an order consists of several Products delivered separately, the withdrawal period starts after receipt of the last Product where applicable under law.

The Consumer may exercise the right of withdrawal by:

  • using the online cancellation function provided by Phipower;
  • using the Model Withdrawal Form;
  • sending an email; or
  • making another unambiguous statement showing the decision to withdraw.

Since 19 June 2026, Dutch online shops must provide consumers with an obvious online cancellation button. The cancellation button does not replace the Model Withdrawal Form; both must remain available.

It is sufficient for the Consumer to send the withdrawal notification before the 14-day period expires.

11. Obligations of the Consumer during the withdrawal period

During the withdrawal period, the Consumer must handle the Product and packaging with reasonable care.

The Consumer may inspect and test the Product only to the extent reasonably necessary to establish its nature, characteristics and functioning, comparable to what would normally be possible in a physical shop.

If the Consumer handles the Product beyond what is reasonably necessary and this causes a reduction in value, Phipower may hold the Consumer liable for that diminished value where permitted by law.

Where reasonably possible, the Consumer should retain the original product packaging during the withdrawal period.

12. Returning a Product after statutory withdrawal

After notifying Phipower of withdrawal, the Consumer must return the Product without undue delay and no later than 14 days after the withdrawal notification.

Unless Phipower agrees otherwise, the Consumer bears the direct cost of returning a Product under the statutory right of withdrawal, provided Phipower informed the Consumer of this before purchase.

The Product should be returned securely packed and with all supplied accessories and documentation.

Phipower recommends using a traceable shipping method and retaining proof of shipment.

The return address shown on the current Phipower Returns page must be used.

The Consumer is requested to submit the Phipower return request before sending a parcel so that the return can be identified quickly.

This request procedure does not restrict the Consumer's statutory right to withdraw by another legally valid method.

13. Refunds after statutory withdrawal

If a Consumer validly withdraws from the entire Agreement during the statutory 14-day period, Phipower will refund the payments that must legally be refunded.

This includes the purchase price and, where applicable, the cost of Phipower's least expensive standard outbound delivery method.

If the Consumer selected a more expensive delivery method than the least expensive standard delivery option, Phipower does not have to refund the additional delivery cost.

Phipower will make the refund without undue delay and within the legally required period.

Phipower may wait until the returned Product has been received or until the Consumer provides evidence that the Product has been sent back, whichever occurs first.

The refund will normally be made using the same payment method used for the original order unless another method is expressly agreed.

14. Phipower voluntary 30-day return policy

In addition to the statutory 14-day withdrawal period that may apply to Consumers, Phipower offers a voluntary 30-day return period for eligible Products.

For clarity and consistency, the 30-day Phipower return period runs from the date the Product is received.

A voluntary return submitted after the statutory withdrawal period has expired is subject to the conditions in this Article.

For such a return, Phipower may require that:

  • the Product is complete;
  • all accessories and parts are included;
  • the Product is undamaged beyond normal inspection;
  • the Product is returned in substantially the same condition in which it was received; and
  • original product packaging is included where reasonably possible.

For voluntary returns outside the statutory withdrawal period:

  • the Customer bears the return shipping costs unless Phipower agrees otherwise;
  • original outbound shipping costs do not have to be refunded;
  • Phipower may offer a refund or exchange;
  • exchanges are subject to product availability; and
  • price differences and additional shipping costs may apply.

Nothing in this voluntary policy limits any statutory withdrawal or conformity rights. See the Returns page for the practical return process.

15. Exceptions to withdrawal

The statutory right of withdrawal does not apply where an exception provided by applicable law applies.

This may include, among other legally permitted cases:

  • Products made to the Consumer's specifications or clearly personalized;
  • sealed Products which are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery;
  • Products that deteriorate or expire rapidly; or
  • other categories expressly excluded by applicable law.

Any relevant exclusion will be communicated to the Consumer before purchase where required.

Phipower will not create withdrawal exclusions beyond those permitted by law.

16. Conformity and defective Products

A Product supplied to a Consumer must conform to the Agreement.

This means that the Product must possess the quality, functionality and other characteristics that the Consumer may reasonably expect on the basis of the Agreement, the product description and applicable law.

If a Product is defective or non-conforming, Phipower is responsible for providing the remedies required by applicable consumer law. Depending on the circumstances, these may include:

  • repair;
  • replacement;
  • price reduction; or
  • termination and refund.

The appropriate remedy depends on the nature of the defect and the applicable legal requirements.

Phipower is responsible for statutory conformity independently of the separate 1-year Phipower warranty described in Article 17.

For EU Consumers, statutory protection for defective goods cannot simply be contractually reduced to the duration of a commercial warranty. EU rules provide at least two years of legal guarantee protection, with national rules potentially providing broader rights.

17. Phipower warranty

Where stated for the relevant Product, the Phipower warranty lasts 1 year from the purchase date. This is the total Phipower product warranty period.

If a defect is accepted as covered under the Phipower warranty during that one-year period, Phipower will provide repair or replacement without charge.

The Customer should report a suspected defect as soon as reasonably possible and preferably within two months after discovering it.

Before returning a Product, the Customer must contact Phipower. Phipower may request reasonable information necessary to assess the issue, such as:

  • order number;
  • product name;
  • photographs;
  • video;
  • display or indicator information;
  • a description of the fault; and
  • reasonable troubleshooting steps.

The Customer should not send a Product back until Phipower has confirmed the appropriate return or service route. This warranty is provided on a carry-in basis: shipping costs to Phipower's service location are at the customer's expense.

If the Phipower warranty period has expired, the Phipower warranty no longer applies. This does not remove any mandatory statutory conformity rights that a Consumer may still have under applicable law — see Article 16. See the Warranty page for the practical claim process.

18. Product use and safety

The Customer must use the Product in accordance with the product manual, operating instructions, safety information and intended use.

The Customer should not deliberately:

  • use a Product in an unsafe manner;
  • bypass safety mechanisms;
  • modify safety-critical electrical or mechanical components; or
  • use accessories or power supplies that are clearly incompatible with the Product.

Some Phipower Products contain or use technologies including electrical current, hydrogen gas, light, glass, moving components or electrical power supplies. Product-specific safety instructions must therefore be followed.

Where a Product has specific contraindications or safety limitations, these will be stated in the relevant product information or manual.

If a Customer has a medical condition, implanted electrical device, is pregnant, uses medication or has another situation that may be relevant to a particular wellness technology, the Customer should follow the applicable product safety guidance and obtain appropriate professional advice where necessary.

19. Complaints and customer service

Phipower aims to resolve complaints directly and reasonably.

Complaints can be submitted through the contact page or by email to info@phipower.org.

Customers should provide sufficient information for Phipower to identify the order and understand the complaint. Where relevant, this may include an order number, photographs or other supporting information.

Phipower will acknowledge and investigate complaints within a reasonable period.

20. Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Phipower is responsible for loss or damage for which it is legally liable.

Phipower is not liable for loss resulting solely from:

  • incorrect use contrary to clear product instructions;
  • unauthorized modification of a Product;
  • use of clearly incompatible components or power supplies; or
  • circumstances attributable entirely to the Customer,

except where liability cannot legally be excluded.

For Business Customers, Phipower may agree separate limitations of liability in a quotation or B2B agreement. To the extent permitted by law in a B2B relationship, liability may be limited to direct and reasonably foreseeable loss and to an agreed contractual amount.

No limitation in this Article excludes liability for intent, deliberate recklessness, death or personal injury where exclusion is prohibited, product liability that cannot legally be excluded, or mandatory consumer rights.

21. Force majeure

Phipower is not liable for failure or delay in performing an obligation where performance is prevented by circumstances beyond its reasonable control and applicable law recognizes those circumstances as force majeure.

This may include exceptional events such as:

  • natural disasters;
  • war or civil unrest;
  • government measures;
  • severe transport disruption;
  • widespread infrastructure failure;
  • strikes outside Phipower's reasonable control; or
  • other exceptional external events.

Phipower will inform affected Customers where reasonably possible and will take reasonable steps to reduce the consequences.

Mandatory consumer rights concerning delivery, cancellation or refunds remain unaffected.

22. Intellectual property

All trademarks, trade names, product names, photographs, videos, illustrations, designs, manuals, website content and other intellectual property displayed by Phipower are owned by or licensed to Mobisun B.V. unless stated otherwise.

Customers may use website content for normal personal and non-commercial purposes.

Commercial reproduction, republication, modification or distribution is not permitted without prior authorization unless allowed by law.

Nothing in an Agreement transfers ownership of Phipower intellectual property to the Customer.

23. Reviews and customer content

Phipower may allow Customers to submit reviews, photographs, videos or other content.

Customer content must be genuine and may not:

  • be knowingly false or misleading;
  • infringe third-party rights;
  • contain unlawful material;
  • constitute spam; or
  • contain abusive or defamatory content.

Phipower may moderate reviews for fraud, spam, illegality or breach of these rules. Phipower will not remove a genuine review merely because it is negative.

Where Phipower wishes to reuse identifiable customer photographs, testimonials or other content in advertising, separate permission may be requested where appropriate.

24. Privacy and cookies

Phipower processes personal data in accordance with its Privacy Policy and applicable data-protection law, including the GDPR.

The Privacy Policy explains, among other things, what data Phipower collects, why the data is processed and what rights data subjects have.

Cookies and similar technologies are governed by the Phipower Cookie Policy.

These Terms & Conditions do not replace the Privacy Policy or Cookie Policy.

25. Business Customers

Articles specifically referring to statutory Consumer rights apply only to Consumers.

Business Customers do not have the statutory 14-day consumer withdrawal right.

For Business Customers:

  • prices may be stated excluding VAT where appropriate;
  • payment conditions may differ;
  • separate delivery or warranty arrangements may be agreed;
  • liability limitations may be agreed more broadly where legally permitted; and
  • quotations, purchase orders and written B2B agreements may supplement or override these Terms.

Where a B2B quotation conflicts with these Terms, the expressly agreed B2B provision takes precedence for that transaction.

26. Governing law and disputes

Dutch law applies to Agreements with Phipower.

For Consumers residing in another country, this choice of law does not deprive them of mandatory consumer protection available under applicable law.

Phipower and the Customer will first attempt to resolve disputes directly.

If a dispute cannot be resolved, it may be submitted to the legally competent court or an applicable recognized alternative dispute-resolution body.

These Terms do not refer to the former European Commission Online Dispute Resolution platform. That ODR platform has been discontinued, and Regulation (EU) 524/2013 was repealed with effect from 20 July 2025.

A clause requiring every Consumer dispute to be brought exclusively before a court chosen by Phipower does not override mandatory jurisdiction rules.

27. Changes to these Terms & Conditions

Phipower may update these Terms & Conditions for future orders, for example because of changes in:

  • legislation;
  • business operations;
  • payment methods;
  • shipping arrangements;
  • website functionality; or
  • Phipower policies.

The most recent revision date will be displayed at the beginning of these Terms.

Changes do not retroactively alter an Agreement already concluded unless the parties agree otherwise or applicable law requires the change.

28. Severability

If one provision of these Terms & Conditions is invalid, unenforceable or contrary to mandatory law, the remaining provisions remain in force.

Where possible, the invalid provision will be replaced or interpreted in a way that complies with applicable law and most closely reflects the original purpose of the provision.
